Qualifying for SSDI or SSI Benefits
If you have suffered a serious injury or illness, we can help you understand if you qualify for benefits and how to get the compensation you deserve. Social Security disability benefits have several restrictions. To qualify, you must meet the following criteria:
- You must have suffered an injury or illness that has or will completely prevent you from working for 12 months or more.
- You must be at least 18 years old.
- You must have worked and paid Social Security taxes for a certain period of time.
- You must reside in the United States.
Supplemental Security Income (SSI) benefits might be available for people who have not worked long enough to qualify for SSDI.
Not all injuries and illnesses will qualify you for SSDI compensation. For a condition to be considered a qualifying condition by the Social Security Administration (SSA), it must be something that prevents you from being able to work for at least 12 months. There is significant case law concerning what illnesses and injuries can qualify. Many people who are denied benefits are denied because they haven't adequately presented the evidence of their condition. We have experience with cases involving a wide variety of conditions that qualify, including:
- Physical injuries
- Psychological/mental conditions
- Back problems
- Heart problems
- Pulmonary and breathing problems
- Cancer
- Diabetes
You do not have to wait until you have been out of work for a full year to file for benefits. In fact, if you don't file within a specified period of time after your injury, your ability to recover can be damaged. We can help you with the important process of collecting medical records and presenting your information properly. There is a lengthy backlog of SSDI claims that are waiting to be reviewed. The sooner you begin the process, the sooner you can collect the money you are owed.
If you have been denied benefits at any level of the process, or if you have questions about whether you should file, you should speak to an attorney right away. Contact our office online, call 419-989-6609 or toll free at 866-442-8398 to schedule your free initial consultation.
